LOS ANGELES--(BUSINESS WIRE)--As the nation awaits the U.S. Supreme Court’s decision over vaccine mandates and how they will affect large companies, human resources and legal professionals continue to grapple with these and other significant developments in labor and employment law in 2021.

“COVID compliance obligations have, by far, caused the most challenges among employers in the past year, as they are ever-changing and often overlapping from a state and local perspective,” said Jeremy Mittman, labor and employment partner at Mitchell Silberberg & Knupp. “It’s been very difficult for legal and HR compliance teams to keep up.”

Other major developments in California law include changes employers need to make to confidentiality and non-disparagement provisions in severance agreements. Recent California court decisions have also affected the way employers need to calculate employee’s pay, such as issues with rounding of employee time and meal-period penalties.

“There are significant costs and implications to calculating these penalties which many employers haven’t previously considered,” Mittman added. “Compliance on these issues has occupied a large portion of our clients’ time in the past year and will continue to be a challenge in the new year.”
